Application Terms and Conditions 2008.2
In consideration of Australian Academy of Sport and Fitness (Hereinafter called 'AASF') entering into and providing training as described on the reverse side of this agreement (the reverse side of this agreement to be read in conjunction with and forming part of this two page agreement) with the person named on the reverse (Hereinafter called the 'Student'), the student hereby agrees to be bound by the following terms and conditions.

1. General
(a) Confirmation of Enrolment (COE) will only be provided on payment of the deposit and receipt of all required forms (signed application form and completed and signed instalment form - when applicable). All successful students will receive notification of enrolment from AASF within seven working days of receiving their application. If you do not receive notification you must contact AASF.
(b) Any funds paid by a Student for training as mentioned in this agreement (including deposits and all other fees paid) are not transferable to any other persons or entity, including deceased or bankrupt estates.
(c) If the Student is paying for the course using the instalment program, the instalment program terms and conditions make up part of these terms and conditions.

2. Payment
(a) The Student agrees to pay AASF the total course fee listed on the LETTER OF OFFER (non-applicable to instalment programs).
(b) A minimum deposit (of 3 months tuition fees and enrolment fee (if applicable)) will reserve a place in the chosen course, students must complete and return all required forms to DIAC for visa application before their course commencement.
(c) AASF will not grant the Student final certification if there is an outstanding balance, including any dishonour or penalty fees.

3. Instalment Program
(a) Students may pay for course tuition on a 3, 6 or 12 month instalment program.
(b) On special consideration by the AASF Campus General Manager students may enter into this agreement with an agreed deposit. To secure this instalment program the student must provide a credit card as method of payment. Students must contact AASF to discuss an instalment program, complete the AASF Instalment program form and provide credit card details to be eligible.
(c) A cancellation fee of 3 months tuition may be debited from the credit card if the student decided to cancel the intended course.

4. Cancellations & Refund Policy
(a) All cancellations must be received in writing. The standard cancellation fee is $50.
(b) If you wish to cancel a course, prior to your starting date, you will receive a full refund minus the cancelation fee if notification is received in writing at least 28 days prior to the commencement of the course. If notification is received in writing within 28 days, cancellation fee of $50 and deduction of enrollment fee will also apply. Please note: NO notification of cancelation will result in NO refund.
(c) Upon commencement of the course, if you do not wish to continue the course, you must apply in writing within 10 days to be eligible for a refund. A cancellation fee of $50 and enrolment fee will be deducted from the refund.
NO refund will be considered for any cancellations after 10 working days from the date of commencement.

Refunds
Student Default
AASF will refund to students all course money less the AASF cancelation fee, for agent commissions and fees students must request directly to agent for refund. To begin the process students must visit there campus and complete a student request form or visit the AASF website “contact us” page to registration request.

Academy Default
AASF will refund in full all amounts To begin the process students must visit there campus and complete a student request form or visit the AASF website “contact us” page to registration request.

Refund process
1.Written notification of cancellation received via form or website
2.Refund request form filled out and given to Accounts
3.Accounts refunds monies
4.Note made in learner/client’s file

5. Deferment
(a) If you are unable to attend where a space has been reserved for you, you may defer to an alternative date at no charge if you provide notification at least 28 days prior to the intended date of deferment.
(b) Non-communication and/or non-attendance without submission of deferment form will result in notification to DIAC for breach of student conditions.
AASF may only enable students to defer or temporarily suspend their studies, including granting a leave of absence, during the course through formal agreement in certain limited circumstances.
ASSF have in place documented procedures for assessing, approving and recording a deferment of the commencement of study or suspension of study for the student, including keeping documentary evidence on the student’s file of the assessment of the application.
AASF can only defer or temporarily suspend the enrolment of the student on the grounds of:
a. compassionate or compelling circumstances
b. misbehaviour by the student
AASF will:
a. inform the student that deferring, suspending or cancelling his or her enrolment may affect your student visa, and
b. notify the Secretary of DEST via PRISMS as required under section 19 of the ESOS Act where the student’s enrolment is deferred, temporarily suspended or cancelled.
• Courses can be deferred for a maximum of 3 months.
• To request for course deferment you must provide notification using the AASF Deferment Form at least 28 days prior to deferment date, payment will be held for the length of deferment and the Immigration Department notified.
• Defer is determined by the General Manager on compassionate or compelling circumstances.
• All deferments must be received, in writing, by the General Manager, requests are open for discussion and a final decision will be made within one week.
• If you are unable to attend where a space has been reserved for you, you may defer to an alternative date at a charge of $50 dollars per week of deferment period. This charge is payable before deferment begins and is refundable (on the next tutuion fee) on return to studies.
• Deferment charge if retained if student does not return on specific date stated on deferment form.

6. Variation of Payments
(a) If the Student is using the instalment program, any change of payment variation must be made through AASF General Manager.
(b) Bank dishonour fees are not refundable.
(c) Students must notify AASF of new credit card expiry dates if participating in the instalment program.

7. Practical Wavier and Release
I hereby WAIVE and RELEASE Kyokushin International Karate Pty Ltd, the Fight Club, New Image fitness Centre and Australian Academy of Sport and Fitness (to be known as the "Released Party") from liability pertaining to the matters **set**forth below. I understand that by signing this form, I expressly and willingly agree to assume complete responsibility for any risk of injury that may arise from my training and study. On behalf of myself, my heirs, my assigns and next of kin, I waive all claims for damages, injuries and death sustained to me or my property, that I may have against the above named Released Party. I do not have any physical limitations, medical aliments, physical or mental disabilities that would limit or prevent me from participating in the above mentioned activity, and. if required, will obtain a medical examination and clearance.

8. Declaration
I ****xp_****that the information I have supplied in this application is correct and complete. I understand that AASF may vary or cancel any decision it makes if the information I have supplied is found to be incorrect or incomplete. I recognise that it is my responsibility to provide all documentary evidence requested in this application. I authorise AASF to obtain further information where deemed necessary. I agree to comply with the rules governing admission and enrolment of AASF. I understand that I am responsible for the prompt payment of any fees related to the program to which I am applying for admission. I understand that AASF may be required to release the information supplied to Commonwealth and State agencies, pursuant to obligations under the Education Services for Overseas Students Act 2000 and the National Code of Practice 2007 for Registration Authorities and Providers of Education and Training to Overseas Students and I hereby authorise the release of information contained in the Application Form to such agencies. I understand that AASF is required by law to inform the Department of Education, Training and Youth Affairs of changes to my enrolment and any breach of a student visa condition relating to satisfactory academic and/or attendance performance.
